Terms of Service

These terms govern your use of https://tryscalepad.co, Scale Pad's advertising services, and the Scale Pad client platform. By applying, booking a call, purchasing a service, or signing in to the platform, you agree to them. If you are acting for a business, you confirm you have authority to bind it.
1. What we do
Scale Pad plans, produces, launches, and manages Meta (Facebook and Instagram) advertising for local service businesses, and provides a platform where clients can see campaign performance, manage leads, share creative assets, and purchase additional services. Specific deliverables, pricing, and timelines are set out on our website at the time of purchase or in a written order.
2. Fees, ad spend, and billing
- Management fees are billed monthly in advance through Stripe unless otherwise agreed. Setup fees, where they apply, are billed once at the start.
- Ad spend is separate. Ads run on your own Meta ad account and are paid by you directly to Meta on your payment method. Our minimum recommended ad spend is $50 per day. We do not mark up ad spend and never hold your ad budget.
- Fees are non-refundable except as stated in the guarantee below or required by law.
- Failed payments may result in paused service after notice. You remain responsible for fees accrued.
- Prices may change with 30 days' notice. Changes never apply to a period already paid.
3. The bookings guarantee
Where advertised, our guarantee is: 10 booked appointments in your first 30 days of live ads, or we continue working at no management fee until you reach 10. The guarantee applies when you: (a) keep ads live at or above the minimum ad spend for the full period; (b) provide the creative assets, access, and approvals we request within 3 business days; (c) respond to leads within one business day and record outcomes in the platform or tell us; and (d) do not pause, edit, or restrict the campaigns yourself. The guarantee covers our fee only. Ad spend is always your cost. "Booked appointment" means a lead who scheduled a time to speak with or visit your business, whether or not they show up or buy.
4. Term and cancellation
Monthly services renew automatically each month until cancelled. Either party may cancel with written notice (email is fine) before the next billing date. Service continues through the end of the paid period. Exclusivity for your service category in your city ends when the engagement ends.
5. Your responsibilities
- Give us and keep active the access we need: your Meta ad account, Facebook Page, Instagram account, pixel, and any other tools agreed.
- Provide truthful information about your business, licenses, pricing, and offers. You are responsible for ensuring your offers and claims are legal in your market.
- Confirm you own or have rights to every video, photo, logo, review, and piece of text you upload to the library or give us, and that we may use them in ads on your behalf.
- Handle leads lawfully, including consent rules for calls and texts. Leads are your customers, not ours.
- Keep your sign-in credentials confidential. You are responsible for activity under your account and by team members you invite.
6. Meta and third-party platforms
Our services depend on Meta and other third parties whose policies and systems we do not control. Ad approvals, account restrictions, delivery changes, and outages can affect results and are outside our control. You agree to follow Meta's Advertising Standards and Terms. When you connect your Meta account, you grant Scale Pad permission to read your ad and Page data and lead form submissions for the purpose of providing the service. The platform does not change your ad account; campaign changes are made by Scale Pad staff in Ads Manager as part of the service.
7. Results
Advertising outcomes vary by market, offer, season, and how quickly leads are followed up. Other than the guarantee in Section 3, we make no promise of any specific number of leads, appointments, jobs, revenue, or return on ad spend. Testimonials and case studies on our website describe individual experiences and are not a promise of your results.
8. Intellectual property
You own your brand, your uploaded assets, and your leads. We own our processes, templates, software, and the platform. Ad creatives we produce for you may be used by you for the duration of the engagement and afterward for your own marketing; we may show them in our portfolio and case studies unless you ask us not to in writing. You grant us a license to use your name and logo to identify you as a client.
9. Acceptable use
Do not use the platform to upload unlawful, infringing, or harmful content; to interfere with or reverse engineer the service; or to access another client's data. We may suspend accounts that violate these terms.
10. Disclaimers and limitation of liability
The services and platform are provided "as is" to the fullest extent permitted by law. Scale Pad is not liable for indirect, incidental, consequential, or lost-profit damages. Our total liability for any claim is limited to the management fees you paid us in the three months before the claim. Nothing here limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify Scale Pad against claims arising from your offers, your business practices, content you supply, or your handling of leads.
12. Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Before filing any claim, both parties agree to try in good faith to resolve the dispute by email or a call within 30 days. Any dispute not resolved will be brought in the state or federal courts located in Texas.
13. Changes to these terms
We may update these terms. The date at the top shows the latest revision. Continued use after a change means you accept it. Material changes will be emailed to active clients.
